Job description

This position is listed on behalf of a partner company, who manages all applications and next steps. Our partner is looking for an Assistant General Counsel, Servicing based in United States.

This is a senior legal role serving as the dedicated counsel to a high-volume servicing organization within a technology-driven financial services environment. You will provide practical, real-time guidance across consumer loan servicing, collections, loss mitigation, and default management. The role combines regulatory expertise with hands-on operational partnership, helping teams navigate complex requirements while maintaining efficient servicing practices. You will work closely with Servicing, Capital Markets, Portfolio Management, and external partners on matters with significant business and customer impact. Your advice will shape policies, procedures, customer communications, vendor relationships, and servicing strategies. The ideal candidate is comfortable taking ownership of complex legal positions and translating regulatory requirements into clear, actionable business guidance.

Accountabilities

  • Serve as the primary legal advisor to the Servicing organization, providing day-to-day counsel on loan servicing, collections, loss mitigation, default management, customer communications, and operational matters.
  • Lead compliance analysis and policy development involving Reg X/RESPA, Reg Z/TILA, FDCPA, UDAAP, TCPA, and applicable state servicing and collections requirements, as well as relevant GSE and agency guidelines.
  • Draft, review, and maintain servicing procedures, loss mitigation policies, and collections strategies to ensure regulatory, procedural, and investor requirements are met.
  • Identify, assess, and mitigate legal and regulatory risks associated with existing and new investment products and servicing strategies.
  • Monitor regulatory and legislative developments and advise stakeholders on implementation requirements and operational impacts.
  • Review and negotiate vendor agreements and statements of work supporting collections and default management, including relationships with third-party collectors, BPO servicers, and foreclosure counsel.
  • Partner with Capital Markets and Portfolio Management on servicing representations, covenants, and compliance obligations connected to asset sales and securitization transactions.
  • Support regulatory examinations and investigations, including responses to consumer complaints escalated through the CFPB, state regulators, or litigation channels.
  • Advise on emerging legal and regulatory considerations related to AI use in collections and financial services operations.
  • Manage multiple high-priority workstreams simultaneously while delivering timely, practical, and well-supported legal recommendations.

Requirements

  • 10+ years of experience practicing law, with substantial experience in consumer loan servicing, collections, default management, mortgage servicing, or related financial services environments.
  • Significant experience ideally gained within an in-house consumer finance or mortgage servicer/subservicer, GSE or agency-approved seller-servicer, consumer finance lender, or comparable organization.
  • Deep working knowledge of consumer servicing and debt collection laws, including FDCPA, TCPA, FCRA, UDAAP, TILA, RESPA, ECOA, and applicable state collections, servicing, foreclosure, title, and lien-resolution requirements.
  • Demonstrated experience advising on loss mitigation structures, post-default strategies, and servicing operations within consumer finance, mortgage finance, or home improvement lending.
  • Strong understanding of FDCPA and TCPA requirements for collections communications, state collections licensing, and the regulatory classification of collections activities.
  • Familiarity with AI governance and emerging regulations affecting the use of artificial intelligence in collections and financial services.
  • Proven ability to provide clear, operationally actionable legal advice and confidently own legal positions in a fast-paced business environment.
  • Juris Doctor degree from an ABA-accredited law school and active membership in good standing with an applicable state bar.
  • Excellent written and verbal communication skills, with the ability to translate complex legal requirements for business professionals and cross-functional stakeholders.
  • Strong collaboration and relationship-building skills, with experience working effectively across internal teams, external counsel, vendors, and business leaders.
  • Excellent organization and prioritization skills, with the ability to manage multiple complex matters under tight deadlines.
